Enabling "citizen developers" and IT teams to build applications collaboratively.
Account Registration and Security
- Eligibility: You must be at least 18 years old and have the legal capacity to enter into a binding contract to register for an account.
- Accuracy: You agree to provide accurate, current, and complete information during the registration process.
- Security: You are responsible for safeguarding your password and for all activities that occur under your User Account. You must notify us immediately of any unauthorized use of your account.
Intellectual Property Rights
Your Data
You retain all ownership rights in and to Your Data. By submitting Your Data, you grant Red Kite a limited, worldwide, royalty-free license to use, host, and process Your Data solely for the purpose of providing and improving the Services to you.
Your Applications
You own the specific applications and workflows you create using the Platform ("Your Applications"). However, the underlying Platform, its reusable components, and the AI-generated code patterns remain the property of Red Kite.
AI-Generated Output
The Platform may utilize artificial intelligence to generate code, workflows, or other outputs. You own the unique output created for you, but you acknowledge that similar or identical output may be generated for other users based on similar prompts or logic.
Your Responsibilities and Acceptable Use
You are solely responsible for Your Data, Your Applications, and your conduct while using our Services.
- Use the Services for any illegal, harmful, or fraudulent activity.
- Violate any applicable laws or regulations, including data privacy and export control laws.
- Upload, post, or transmit any content that is infringing, libelous, unlawful, or contains viruses or malicious code.
- Reverse engineer, decompile, or attempt to discover the source code of the Platform.
- Use the Services to build a competitive product or service or to copy our features.
Fees and Payment
Certain Services, particularly consulting and premium Platform access, are subject to fees. The specific fees, payment terms, and billing cycles will be detailed in a separate order form, subscription plan, or statement of work ("Order Form"). All fees are non-refundable unless otherwise stated in the Order Form. Late payments may be subject to interest charges.
Confidentiality
Both parties agree to hold each other's confidential information in confidence and not to use or disclose it except as necessary to perform under these Terms. "Confidential Information" includes business plans, technology, technical processes, and Your Data.
Disclaimer of Warranties
THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. RED KITE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RED KITE, ITS DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNTS PAID BY YOU TO RED KITE IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
Term and Termination
These Terms will remain in effect while you use the Site or Services. We may suspend or terminate your User Account and access to the Services at any time for any reason, including if you breach these Terms. Upon termination, your right to use the Services will cease immediately.
